The BUYER (identified at the bottom of this agreement) agrees to purchase a cat/kitten from the BREEDER . 

CONTRACT TYPE:

TERMS OF SALE 


HEATH GUARANTEE

The BREEDER guarantees that at the date of transfer the cat/kitten was in good health, displayed no visible signs of genetic defects, and had no parasites or viral diseases. If the cat/kitten is found to be of unsound health, the BUYER must present an itemized statement from a board certified veterinarian that includes a confirmed identification of the cat/kitten via it’s microchip number. Genetic defects are guaranteed against for the period of two (2) years. 


The BREEDER confirms that the cat/kitten has had well cat/kitten exams, which includes deworming and standard vaccinations. 

No one can guarantee that a cat/kitten will never get FIP. BREEDER guarantees to replace kitten with kitten of equal quality in the event that a kitten dies of FIP within the first (1) year of life. This diagnosis must be confirmed by a board-certified veterinarian via post-mortem necropsy report that includes a confirmed identification of the cat/kitten via it’s microchip number. 

If the cat/kitten is diagnosed with FIP, BUYER promises to contact BREEDER as soon as kitten is diagnosed with FIP. Additionally, the BUYER agrees that the cat/kitten will not be euthanized (following a FIP diagnosis) without first contacting BREEDER .


TRANSITION PERIOD

The BUYER agrees to keep the cat/kitten quarantined for a period of 14 days AND until the cat/kitten has been examined by a board-certified veterinarian. . This is especially true of other household pets.  This is to reduce stress on the kitten. The BREEDER is not responsible for any injury or illness to any human or animal in the new household. 


BUYER RESPONSIBILITY 

The BUYER agrees to have the cat/kitten examined by a board-certified veterinarian within 14 days of its arrival. 

The BUYER is responsible for all standard veterinary medical costs that may be incurred. The BUYER agrees to provide a life-long commitment of care which includes: premium quality cat food, fresh water, comfortable environment, prompt medical attention when needed, proper grooming, responsible care and affection.


BUYER also agrees to not lease or resell the cat/kitten to another party without the written permission of the BREEDER. This includes pet stores, pet consignment stores or research laboratories. 


BUYER agrees that the cat/kitten will not be allowed to free roam outdoors without a harness and leash. Outdoor “supervision” is not acceptable. BUYER also agrees that the cat/kitten will not be kept in a cage. 


The BUYER agrees that the cat/kitten will NEVER be declawed. If the cat/kitten is found to have been declawed, all health guarantees are null/void. 


PAYMENT

1. The total purchase price of the cat/kitten is listed at the top of this contract.

2. Purchase price includes a $200 non-refundable deposit.  

3. BUYER understands that the $200 waitlist deposit is considered non-refundable unless the cat/kitten is unable to be delivered for unforeseen circumstances 

  1. Cat/kitten is considered reserved once a deposit and       signed contract is received from the BUYER.
  2. BREEDER       agrees that cat/kitten will not be sold to any other       interested parties.

4. BREEDER agrees to return $200 non-refundable deposit to the BUYERin the event that the cat/kitten is deemed unfit for adoption due to unforeseen circumstances such as late stage health or temperament issues.

5. BUYER agrees to the payment schedule as outlined below:

  • Total cost - $200 = Balance
  • 30% of balance due at 8 weeks
  • 30% of balance due at 12 weeks
  • Remaining balance due (in       case) at kitten’s go home date

6. The following payment types are accepted:

  • Cash
  • Zelle
  • Cashier’s check
  • Money Order

 

TRANSPORTATION COSTS

BUYER assumes responsibility for all transportation costs. BUYER can choose to pick kitten up from local airport or have kitten delivered by BREEDER . BUYER understands that if chosen, the delivery cost is the price of the plane ticket (via Delta) + lodging if required + $150 fee. 


REPLACEMENT KITTEN

If a claim must be made against any of the guarantees listed above, the BREEDER agrees to replace the cat/kitten with one of like quality. The BREEDER makes no guarantee of same color/ or pattern. BUYER understands that it may take up to 1 year to receive a replacement cat/kitten.

 

RESERVATION

The BREEDER agrees that the cat/kitten is considered reserved once a deposit and signed contract is received from the BUYER. BREEDER agrees that cat/kitten will not be sold to any other interested parties.


LIABILITY LIMITS

The BREEDER ’S liability is limited strictly to the purchase price of the kitten and does not include any transportation costs. 


The BREEDER makes no guarantees about the cat/kitten’s show career, his/her hypoallergenic properties or general personality. 


Unless otherwise listed above, the BREEDER is in no way obligated to return monetary funds. If the SELLER declines a replacement kitten under the terms of the contract, the contract will be considered fulfilled. 


DISPUTES

Both parties agree that disputes will be handled and resolved in a private manner. Issues will not be aired in any public forum including social media up to and including entities such as Facebook, Twitter, Instagram or Yelp.
